Terms of Service

These Terms of Service (“Terms”) govern your access to and use of IEP Ally Binder (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on your own behalf (for example, as a parent or guardian) to use the Service. The Service is intended to help adults organize documents and information related to a child's education; it is not intended for use by children.

Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you believe your account has been accessed without authorization.

Subscription, free trial, and billing

  • New accounts include a 14-day free trial.
  • After the trial period, continued access to the Service requires an active paid subscription (currently $9/month, billed on a recurring basis until canceled).
  • You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period, and you will not be charged for subsequent periods.
  • Fees are non-refundable except as required by law or as we expressly state otherwise.

Your content

You retain ownership of all documents, files, and information you upload to the Service (“Your Content”). By uploading Your Content, you grant us a limited license to host, store, and display Your Content back to you solely for the purpose of operating the Service. We do not claim any ownership rights in Your Content and will not use it for any purpose other than providing the Service to you.

You are solely responsible for Your Content and for ensuring you have the right to upload it. You agree not to upload content that is unlawful, infringes another person's rights, or that you do not have permission to share.

Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems
  • Interfere with or disrupt the Service, including through excessive automated requests
  • Upload malicious code or content that violates the rights of others

We reserve the right to suspend or terminate accounts that violate these Terms.

Account suspension, deletion, and data retention

If your account is suspended — for example, due to a billing issue or a violation of these Terms — you may lose access to the Service and Your Content for a period before Your Content is permanently deleted. We will make reasonable efforts to notify you before permanent deletion occurs. Once Your Content is deleted, it cannot be recovered.

Disclaimers

The Service is an organizational tool, not legal or educational advice. IEP Ally Binder helps you store, organize, and track documents and deadlines related to your child's IEP or 504 plan. It does not provide legal advice, advocacy services, or guarantees about outcomes in any meeting, evaluation, or dispute. Always consult a qualified attorney, advocate, or your child's school for guidance specific to your situation.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IEP ALLY BINDER AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if required by law.

Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the app. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the United States, without regard to conflict of laws principles. If a court determines any provision of these Terms is unenforceable, the remaining provisions will remain in full effect.
